1. Parties and Acceptance
These Terms of Service ("Terms") constitute an agreement between GENEZ LLC ("Phoniq", "we") and individuals using our services ("User", "you").
By registering with Phoniq or using our services, you agree to these Terms.
2. Service Description
Phoniq is an AI-powered English conversation practice platform. The service includes:
- An AI English coach that proactively calls users at scheduled times
- Automatic language analysis and scoring after each conversation
- Level testing and progress tracking
- A minute-based balance system
3. Account Creation
- You must be at least 18 years old to create an account.
- You are responsible for ensuring the accuracy of the information you provide.
- You are responsible for maintaining the security of your account.
- You may not transfer or share your account with others.
4. Payment and Billing
Balance System
Phoniq uses a pay-per-minute model, not a subscription. You must load balance before using the service.
Pricing
- The per-minute rate is locked to the USD/TRY exchange rate at the time of plan creation.
- Prices are periodically updated based on the TCMB exchange rate.

Refund Policy
- If you end the call early: remaining minutes are refunded to your balance.
- If the call is dropped due to a technical issue: remaining time is refunded.
- If you do not answer after three attempts: no charge is applied.

Payment Processing
Payments are processed via Stripe. Card details are not stored in Phoniq's systems.
5. Acceptable Use
The following uses are prohibited:
- Abusing the service with automated systems
- Using the AI coach for off-purpose activities (threats, harassment, etc.)
- Unauthorized access to another user's account
- Sharing content that infringes copyright
- Reselling or commercially licensing the service without permission
6. Voice Recording and Transcript
Calls are recorded and transcribed. Explicit consent is obtained during registration. Voice recordings are stored for 30 days; transcripts are retained permanently.
7. Intellectual Property
The Phoniq platform, design, software, and content belong to GENEZ LLC. Users retain personal rights over the content of their conversation transcripts.
8. Account Suspension
Your account may be suspended in the following cases:
- Violation of these Terms
- Payment issues (insufficient balance)
- Posing a threat to system security

9. Limitation of Liability
Phoniq does not guarantee uninterrupted or error-free service. Except for direct damages caused by technical failures, we accept no liability for indirect damages.
9.1 AI Response Issues During Calls
During calls, the AI coach may occasionally experience delays or temporary unresponsiveness due to technical reasons. In such cases:
- If the AI does not respond for 30 seconds, the call is automatically terminated by the system.
- You are only charged for the actual conversation time up to the point of disconnection. Any remaining unused minutes are refunded to your balance.
- If you choose not to hang up during an AI silence period and remain on the line, the resulting charges are your responsibility and no refund will be issued for that waiting time.
- For technical failures originating from our systems (connection errors, server issues), the remaining balance for that call is automatically refunded.
- We recommend ending the call if the AI does not respond within a few seconds. Since you are only charged for actual conversation time, there is no financial risk in hanging up and scheduling a new call.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, USA. For users in Turkey, applicable Turkish consumer regulations also apply.
11. Changes
Material changes to these Terms will be communicated by email 30 days in advance. The current version is always available on this page.
